Minor Material Amendment Successfully Challenged on Appeal

BJC Planning are pleased to report their success at appeal against the refusal of permission for an amended scheme for the construction of dormer windows, balcony and roof lights in a Southsea Conservation Area.

Refusal of an application for a ‘minor material amendment’ was successfully challenged on appeal.  The scheme had not been built in accordance with the originally permitted plans and had been the subject of a MMA application which the Council refused.  BJC Planning drew upon the Council’s own conservation area guidance principles to demonstrate that the proposed amendments were not in conflict with policy and that no harm was caused to the Conservation Area.
