Chris is pleased to receive an appeal decision which granted permission for the change of use of a HMO to 3 flats in Southampton.  Southampton City Council had argued that as the HMO had at least 3 bedrooms and a garden, this change would result in the loss of a family home.

The Inspector agreed with the appellant (represented by BJC Planning), that just because the building had three bedrooms and a garden it did not mean that this should be considered to be a family home.  Hence there was not a conflict with Policy SC16.  The decision is especially welcome as a previous appeal had failed on this point.
